Although there are a few people running on 40mhz it is not FCC legal to use in the US. If your looking for a band that few RC'rs are using that is legal you can get your ham radio operators lisence and use 50mhz. But then you could always get glitch by ham radios.

but my other friend who works with radio signals and builds wireless devices checked on the frequencies at his work (they have a huge list of frequencies and what they are for)
40.600-40.700 is unlicensed radio frequencies :o
anyone can use it :)

Ask any radio manufacturer and they will refuse to sell you a radio on the 40mhz band within the US because the channels used for RC in 40mhz are not legal channels with the FCC. RC is restricted to 27mhz, 50mhz, 72mhz, and 75mhz. You can get 40mhz radios by ordering from Europe or Asia but that doesn't make them legal.

Here's a pretty cool chart showing frequency usage. If you're using a 40Mhz radio, you're interferring with mobile/fixed government communications. :eek:

The one I posted comes from a link sent to me by the FCC in response to a question I sent them reguarding RC frequencies...here's the e-mail I got from them...

We use 40mhz over here in australia. We don't use 75mhz cos taxi's use them. Hehehe :D
